Terms of Service

1. About the Service

Zavelle AI (the “Service”) is provided by Planting Software, a sole proprietorship registered in Norway, organization number 938 374 422, Skjønefjellveien 8C, 4517 Mandal, Norway (“we”, “us”). The Service gives you access to AI tools for text, images, video, real-time voice and code, powered by models from third-party providers, including Anthropic, OpenAI and Google.

By creating an account or using the Service you agree to these Terms. You must be at least 18 years old, or have consent from a parent or guardian, to use the Service.

2. Your account

• You are responsible for all activity on your account and for keeping your login secure.
• Accounts are personal and may not be shared or resold.
• You must provide an accurate email address and payment details.

3. Subscriptions and pricing

Prices are in US dollars. Applicable VAT or sales tax may be added. Subscriptions renew automatically for the same period and are charged to your card at the start of each period until you cancel. Payments are processed by Stripe.

4. Trial

• The trial lasts 3 days and costs $1, charged immediately. A valid payment card is required.
• Unless you cancel before the trial ends, it automatically converts to the plan you selected and the full price is charged.
• The trial has reduced quotas and does not include video generation or Zavelle Code.
• Each person and each payment card is limited to one trial. If a card has already been used for a trial, the subscription starts at full price immediately.
• Upgrading during the trial ends the trial and the new plan is charged immediately.

5. Quotas and fair use

Each plan includes monthly quotas for text, images, video and voice, as shown on the pricing page and in your account. Yearly plans receive monthly quotas. Unused quota does not roll over to the next month.

• Zavelle Code runs each task in a private cloud sandbox with a spending cap per task. A task that reaches its cap pauses; you can choose to continue it, which uses more of your Code quota.
• Text usage is measured in credits that reflect the actual cost of your requests. Long conversations and long answers use more than short ones.
• When a quota runs out, you can wait for next month, upgrade, or buy add-ons where offered.
• Failed generations are not deducted from your quota. If you stop an answer midway, what was already generated is deducted.
• We may limit the number of requests per minute and temporarily restrict the Service during unusually high load to protect the Service and other users.

6. Extra video credits

You can buy extra video clips (Pro: $5 for 3 clips, Ultra: $25 for 5 clips). Add-on credits cannot be purchased during the trial. They are used after your monthly quota is exhausted and do not expire while you have an active subscription. Credits bought on Pro cannot be used with the Ultra model. Credits are non-refundable and cannot be exchanged for cash.

7. Changing plans

• Upgrades take effect immediately. You are charged a prorated amount for the rest of the period and receive the new quotas right away. Usage so far this month still counts.
• Downgrades take effect at your next renewal.

8. Cancellation and refunds

You can cancel at any time under “Manage” on your account page. Cancellation takes effect at the end of the period you have paid for, and you keep access until then. We do not refund partially used periods, except where required by mandatory law.

9. Right of withdrawal

Consumers in the EU/EEA normally have a 14-day right of withdrawal for digital services. Because the Service is delivered immediately, we ask for your express consent to begin delivery right away. When you give this consent at purchase and acknowledge it, you lose the right of withdrawal for the part of the Service already delivered.

10. Acceptable use

You may not use the Service to:

• create or share content that is illegal, infringes the rights of others, or exploits children;
• harass, threaten, defraud or mislead others, including deepfakes of real people without their consent;
• circumvent quotas, payment systems, security measures or content filters;
• scrape data automatically, resell access or share your account;
• use Zavelle Code to build malware, attack systems, mine cryptocurrency or run services from the sandbox;
• violate the usage policies of the model providers (Anthropic, OpenAI and Google).

Requests may be declined by the providers’ safety filters. If you breach these Terms, we may restrict, suspend or close your account without refund.

11. Content and rights

• You keep the rights to what you submit. To the extent permitted by law and the providers’ terms, the generated output belongs to you.
• You grant us the right to process your content as needed to provide the Service, as described in our Privacy Policy.
• AI-generated content may be inaccurate, incomplete or resemble existing works. You are responsible for reviewing output before using it and for making sure your use is lawful.

12. Availability and changes to the Service

We work to keep the Service available but do not guarantee it will always be uninterrupted or error-free. The Service depends on third-party providers. We may replace or update models with equivalent or better alternatives.

13. Limitation of liability

To the extent permitted by law, our total liability is limited to the amount you paid for the Service in the three months before the claim. We are not liable for indirect losses such as lost profits or loss of data. These limitations do not apply in cases of gross negligence or intent, and do not limit your rights as a consumer under mandatory law.

14. Suspension

We may suspend an account immediately in case of suspected fraud, abuse, payment chargebacks or breach of these Terms.

15. Affiliate program

• Affiliates with a paid subscription earn 15% commission on subscription payments (excluding tax) from customers they refer, for as long as the customer stays subscribed.
• Commissions are held for 30 days and are reversed on refunds or chargebacks.
• Self-referrals, spam, misleading advertising and bidding on our brand name are not allowed.
• We may change or end the program with 30 days’ notice. Commissions already earned will be paid out.

16. Changes to these Terms and to prices

We may change these Terms and our prices. Material changes are announced by email at least 30 days before they take effect. Price changes apply from your next renewal after the notice period. If you do not agree, you can cancel before the change takes effect.

17. Governing law and disputes

These Terms are governed by Norwegian law. We will first try to resolve any dispute amicably. Consumers may also contact their local consumer protection authority. Otherwise, disputes are settled by the courts of the owner’s place of residence in Norway, unless mandatory law gives you the right to bring a claim where you live.
